Jamie Foxx Faces Lawsuit Alleging Sexual Assault at NYC Rooftop Bar
It seems like 2023 isn't turning out to be a great year for Jamie Foxx. After a mysterious medical emergency in April, the actor is now facing a lawsuit alleging sexual assault at a New York City rooftop bar eight years ago. Here's what the case alleges and what could happen next.
The Allegations
The lawsuit, filed at the New York Supreme Court, claims that on August 26, 2015, an incident occurred at the Catch NYC & Rooftop Bar involving Jamie Foxx. The plaintiff, referred to as "Jane Doe," states that she and her friend arrived at the bar around 11:00 pm and noticed Foxx sitting at a table with his friend Mark Birnbaum, who is also named in the suit.
According to the document, a crowd gathered around Foxx and Birnbaum, but Jane Doe and her friend were not asked to move. The plaintiff's friend then approached Foxx, who appeared intoxicated, to ask if she could take some photos. It's alleged that Foxx made inappropriate comments to Jane Doe, including remarks about her body and a comparison to actress Gabrielle Union.
Things took a disturbing turn when Foxx allegedly grabbed Jane Doe by the arm and pulled her to the back area of the bar. The plaintiff claims that he then touched her breasts and genitals without her consent. The assault only stopped when her friend arrived.
Jane Doe states that she has suffered from post-traumatic stress disorder and lingering psychological damage as a result of the incident. She is seeking damages that exceed the monetary limits of all lower courts, as well as punitive damages.
Foxx's Response
So far, Jamie Foxx and his representatives have not commented on the lawsuit. If the case proceeds, it is expected that Foxx's legal team will first attempt to have the lawsuit dismissed. This could result in a hearing before the end of the year. Alternatively, Foxx may choose to settle the case out of court, in which case further details may not be made public.
